Pensions

Brodies has experience in advising on pensions in an employment context and in purchases and sales of assets and transfers of businesses, both in the public and private sectors. We have additional experience in this area through our trust and tax specialists.


We also have the experience of acting for and advising a broad range of clients on all aspects of pensions law. Our pensions expert, Ewan Nelson, advises employers and trustees in relation to a wide range of pensions issues including mergers, corporate transactions, pension scheme reorganisation and closure, scheme funding and winding up. He also has a broad range of experience acting in contentious matters including disputes before the Pensions Ombudsman, Employment Tribunals and the Courts.


To give you a flavour of the relevant experience we have to date, the following examples are of work Brodies have carried out to date:

 

  • advising a local authority on a variety of matters including drafting of documentation, legislative provisions and procurement of service providers such as actuaries and fund managers
  • advising trustees on the legislative provisions of the Pensions Act 2004 and the Finance Act 2004, and drafting amendments to the trust deed and rules to reflect the new requirements
  • advising a local authority on the restructuring of funds and contribution levels between funds
  • advising both local authorities and local authority contractors in a number of recent public sector transactions, in relation to admission agreements permitting the contractor to participate in the local government scheme
  • advising a number of employers in relation to the impact of the new age discrimination regulations on their pension schemes
