Commercial Disputes

Construction

Acting on behalf of pursuers and defenders we regularly handle construction disputes at the Court of Session as well as in the Sheriff Court. We also receive instructions from insurers where negligence is claimed. Our contentious practice is backed by construction head Mark Finlay and his team.

Commercial Contracts

We are able to handle anything you throw at us. Very much the bread and butter of our commercial litigation team we deal with all sorts of disputes arising out of commercial contracts through litigation, arbitration, negotiation and mediation.

ADR & Arbitration

While arbitration in Scotland is not as well developed as in England and has perhaps lost out to the commercial court in recent years we have experience of arbitration as well as mediation. Mediation still has to take off in Scotland where with the exception of family law cases the court cannot force parties to mediate.

Banking

Working closely with our non-contentious banking team and overlapping with our insolvency team we have been involved in a number of landmark cases. We also cover security work arising from calling up standard securities-link to banking & insolvency.

Property Litigation

Being very strong in property as a firm we have a dedicated property litigation team which covers all aspects of property litigation from disputes over servitudes to rent reviews in major commercial leases. Current matters range from Lands Tribunal cases to the interpretation of keep open clauses via questions as to the reasonableness of landlords and the law of nuisance.

We are also experienced in licensing work.

Technology

We deal with all aspects of contentious IT/IP and have cases involving copyright, design rights, trademarks as well as contractual disputes over IT contracts and domain name rights.

Professional Negligence

We act for both pursuers and defenders as well as forinsurers in relation to claims against numerous other professionals rangingfrom accountants to architects.

Advocacy

We have two solicitor advocates, partners Joyce Cullen and Robin Macpherson. We actively encourage all of our litigation solicitors to develop their advocacy skills.

Media

We are experienced in dealing with urgent interim interdict applications aswell as advising on defamation matters.

Corporate Litigation

We are experienced in handling corporate litigation cases. In this area ourwork includes everything from minority shareholder claims to insolvency issues arising in receiverships and liquidations.
